2. This is an application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested in connection with Crime No.244/2020, registered at Police Station Mohan Nagar, District Durg Chhattisgarh for the offence punishable under Section 307 of the I.P.C. and Section 25 & 27 of the Arms Act.

3. After arguing for sometime, learned counsel for the applicant

MCRC No. 8435 of 2020 seeks permission of the Court to withdraw the bail application with liberty to revive the prayer after examination of the victim Ganeshwar Samant Rai.

4. Permission granted.

5. Accordingly, the bail application is dismissed as withdrawn with the aforesaid liberty.
