Heard counsel for the Appellant and counsel for the State. 2.

There is no infirmity in the order of the learned Single Judge in remanding to the appellate authority to consider the matter in the light of decision and direction issued by the Hon'ble Supreme Court, abstracts of which have been quoted in the said order.

Since the employee has retired in the year 2010, the appellate authority is directed to give priority and decide the matter within a period of three months from the date of receipt of a copy of this order. 4.

The appeal is otherwise dismissed.
