1. This is a repeat bail application filed under Section 439 Cr.P.C. for grant of bail to the applicant, who has been arrested in connection with Crime No. 98/2016 registered at Police Station A.J.K. Korba, Chhattisgarh for the offence punishable under Section 376 of Indian Penal Code and Sections 4 & 6 of the Protection of Children from the Sexual Offences Act, 2012 and Section 3(2) 5 of Schedule Caste and Schedule Tribe (Prevention of Atrocities) Act, 1989.
2. The earlier bail application stood rejected by this Court on 28.03.2018. While disposing the previous bail application, this Court had taken note of age of the prosecutrix and also the fact that most of the prosecution witnesses have been examined.
3. After the disposal of the bail application, there does not appear to be any substantial progress in the trial.
4. Given the said facts, though this Court is not inclined to grant the advantage of bail to the applicant; however the bail application stands disposed off with a direction to the trial Court to ensure that the leftover witnesses are summoned at the earliest and the trial itself is concluded at the earliest.
5. With the aforesaid observations, the present MCRC stands disposed off.
