1. Learned counsel for the applicant prays that as three witnesses have already been examined by the prosecution during trial, hence as instructed, instant MCRC may be disposed of as withdrawn reserving liberty to the applicant to file repeat application before the trial Court.

2. As prayed, instant MCRC is disposed of as withdrawn reserving aforesaid liberty if available under the law. If any repeat application is filed by the applicant before the trial Court, the same be disposed of on the basis of entire merits of the case.
