1. Heard finally.

2. The applicant has preferred this application for grant of bail as he is arrested on 17-3-2017 in connection with Crime No. 133/2017 registered in PS Arang, Distt. Raipur (CG) for offence punishable under Section 3 and 7 of the Essential Commodities Act.

3. Learned counsel for the applicant submits that after investigation charge sheet has been filed and the matter is pending before the JMFC, Raipur. This is his first bail applicant before this Court. He is first offender. He will not commit any offence in future if granted bail. He may be granted bail as the trial may take time. As per allegation, from the garage of the applicant, 300 litre diesel and 1200 litre petrol have been seized. Learned counsel submits that as the applicant is a mechanic, he kept the diesel and petrol in his garage. Therefore, the applicant may be enlarged on bail.

4. Learned State counsel opposes the argument advanced on behalf of the applicant and submits that the bail application may be rejected.

5. Perused the matter.

6. There is no explanation under what authority the applicant was keeping aforementioned huge amount of diesel and petrol. On due consideration, I am not inclined to grant bail to the applicant.

7. The instant MCRC is dismissed.
