1. Heard.

2. This is an application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested in connection with Crime No.679/2020, registered at Police Station City Kotwali, District Durg Chhattisgarh for the offence punishable under Sections 457, 380, 427, 511/34 of the I.P.C.

3. Applicant along with co-accused Dharam Sahu were

MCRC No. 8449 of 2020 attempting to commit theft of ATM machine during the intervening night of 7-8th October, 2020.

4. Learned State counsel would oppose the prayer for grant of bail.

5. Considering that the applicant is in jail since 8.10.2020; charge-sheet has already been filed and the offences are triable by JMFC, I am inclined to release him on bail.

6. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
