1. Heard.

2. This is an application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested in connection with Crime No.486/2020, registered at Police Station Kotwali, Ambikapur, District Surguja Chhattisgarh for the offence punishable under Sections 307, 147, 148, 149, 188, 120-B of the I.P.C. and Section 25, 27 of the Arms Act.

3. As per the prosecution case, the present applicant along

MCRC No. 8441 of 2020 with co-accused Mohammed Salim Khan and four other accused persons formed an unlawful assembly and assaulted the complainant Ajay Vishwakarma and two other by means of club, sword, iron rod and knife.

4. Admittedly, co-accused Mohammed Salim Khan facing similar allegation has already been released on bail by this Court in MCRC No.7179 of 2020 vide order dated 09.11.2020.

5. Learned State counsel would oppose the prayer for grant of bail.

6. Considering all relevant aspects of the matter particularly for the fact that the present applicant is in jail since 01.09.2020 and the charge-sheet has already been filed, I am inclined to release him on bail.

7. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
