On due consideration, the same is allowed. Consequently, the delay of 27 days in filing of the appeal is condoned. Heard on Application for Grant of Leave to Appeal. Perused the statement of PW-1 & PW-2. Considering the same, the application for Leave to Appeal is allowed, as it appears that the case is arguable.

Registry is directed to register the case as Acquittal Appeal. Issue bailable warrant to the Respondents for a sum of Rs.5000/- for their appearance before this Court on 26th September, 2017. List the case on 26th September, 2017.
