1. The applicant has preferred this application for grant of anticipatory bail, as he apprehends his arrest in connection with Crime No.79/20, registered at Police Station Narayanpur, District- Jashpur, (C.G.) for offence punishable under Section 420, 34 of the Indian Penal Code.

2. On the basis of report submitted by the Block Education OfÏcer, Bagicha, the instant First Information Report has been registered against five accused persons on allegation that

they have collected Rs.13,47,000/- from the employees of the Bharat Mata Higher Secondary School, Ramsama, a private school, on promise that their post would be recommended for grant of aid from the State Government.

3. It is argued that applicant is working as a teacher in the said school and had himself has paid Rs.60,000/-, therefore, he is a victim rather than an accused.

4. Learned State counsel would submit that although the applicant has paid Rs.60,000/- to the management but he is also a part of a team who has collected the amount.

5. Having considered the material available in the case diary, particularly considering the fact that applicant has paid Rs.60,000/- to the management of the School for the same purpose for which other employees have been defrauded, I am inclined to extend the benefit of anticipatory bail to the applicant.

Accordingly, the application is allowed and it is directed that in the event of arrest of the applicant, he shall be released on anticipatory bail on his executing a personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand Only) with one surety in the like sum to the satisfaction of the arresting ofÏcer with the following conditions:- • he shall make himself available for interrogation by a police ofÏcer as and when required;

• he shall not directly or indirectly make any inducement,

threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police ofÏcer. • he shall not influence the witnesses during pendency of the trial.
