Hon'ble Shri Justice P. Sam Koshy Order on Board 29.08.2018 1.
The only grievance of the petitioner is that the petitioner as on date is posted as Assistant Professor at College of Agriculture and Research Station, Janjgir Champa and that her Husband is posted at Raipur and that the Husband's post is a non-transferable post and that post is only available at Raipur. Therefore, the petitioner prays that she may be considered for being transferred to any place near Raipur more particularly preferably at Indira Gandhi Krishi Vishwavidyalaya, Raipur. The petitioner in this regard has already made a representation to the authorities concerned, but till date no decision has been taken.
2.
Given the nature of dispute, this court does not intend to keep this petition pending. Rather ends of justice would meet if a direction is given to the respondent No.1 to consider the claim of the petitioner
for transfer in accordance with transfer policy of the State pertaining to the spouse being in employment.
3.
Accordingly, the petition stands disposed of. Let an appropriate decision be taken by the respondent within an outer limit of 60 days from the date of receipt of certified copy of this order. Sd/- (P. Sam Koshy Judge inder
