The grievance of the petitioners in the instant Writ Petition is the inaction on part of the respondents in not considering the claim of the petitioners for promotion to the post of Dresser-Grade-I. 2.

According to the counsel for the petitioners, the post of Dresser-Grade-I is lying vacant in the department for a considerable period of time. He further submits that, the petitioners have obtained all the requisite qualification and experience for the said post and the said requirement was also fulfilled on the basis of the instructions issued by the State Government in this regard. He further submits that, since all the petitioners are discharging their duties on the post of Dresser-Grade-I, they made be considered for promotion on the said post as per the directives issued by the department in their favour. 3.

Perusal of the statutory rules governing the service condition of the petitioners, it appears that the petitioners would be entitled for promotion from the present substantive post that they are holding i.e. of Aaya/Sweeper/Ward Boy/Choukidaar and the promotional post is that of Dresser-Grade-II and the requisite eligibility criteria is 5 years experience and the candidate should have passed Higher Secondary or High School Examination in 10+2 division system.

The petitioners it appears have already made representation vide Annexure-P/17 dated 09/01/2018 to the respondent No.3, but no decision has been taken till date.

In the given facts so also taking note of the various correspondences made by the department in respect of the duties which have been assigned

to the petitioners from time to time, let the petitioners make a detailed representation to the respondent No.2 who in turn shall consider the case of the petitioners and pass an appropriate order in accordance with the rules and regulations governing the service condition of the petitioners. 6.

Let this exercise be done within a period of 4 months from the date of receipt of certified copy of this order.
