The applicant has preferred this bail application as he has been arrested in connection with Crime No.130/2016, registered at Police Station Fingeshwar, District Gariyaband (C.G.) for offence punishable under Section 302/34 IPC.

Applicant has allegedly committed murder of deceased Ravi Shankar, who was having illicit relation with applicant's sister Uma Bai. As per the allegation, the applicant and juvenile coaccused Shivam assaulted the deceased by means of club, however, there is no eye witness to the crime nor there is any evidence in the nature of extra judicial confession or last seen together. The applicant seems to have been implicated only on
the basis of recovery of club pursuant to his memorandum statement.

Considering the nature of evidence against the applicant and for the fact that the investigation is already complete, this Court is inclined to release the applicant on bail.

Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the trial Court. The applicant is directed to appear before the trial Court on each and every date given by the said Court.
