1. This is an application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicants, who have been arrested in connection with Crime No.45/2020, registered at Police Station Sahaspur Lohara District Kabirdham C.G., for the offence punishable under Section 34(1)a, 34(2) of the Chhattisgarh Excise Act, 1915.

2. As per the prosecution case, applicants were found in illicit

MCRC No. 8751 of 2020 possession of 252 bulk liters of foreign liquor when they were traveling in a four wheeler on 23.9.2020.

3. Learned State counsel would oppose the prayer for grant of bail. However, she would submit that the concerned SHO has not reported any previous antecedents of the applicants.

4. Considering the offences are triable by JMFC and the applicants are in jail since 23.09.2020 i.e., for more than five months as also the charge-sheet has already been filed, I am inclined to release the applicants on bail.

5. Accordingly, the application is allowed and the applicants are directed to be released on bail on each of them executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. They are directed to appear before the trial Court on each and every date given by the said Court.
