Petitioner versus 1.
State of Chhattisgarh, through its Secretary, Health and Family Welfare Department, Mantralay, Atal Nagar, Naya Raipur (CG) 2.
Director, Health Services, Indravati Bhavan, Watal Nagar, Naya Raipur, District Raipur (CG) 3.
Chief Medical and Health Officer, Gariyabandh (CG) 4.
Collector, Gariyabandh, District Gariyabandh (CG) ... Respondents For Petitioner :
Mr. Gary Mukhopadhyay, Advocate.
For Respondents :
Mr. Anshuman Shrivastava, Panel Lawyer.
Hon'ble Shri Justice P. Sam Koshy Order on Board 14/08/2019 1.
The petitioner in the present writ petition is aggrieved by order dated 12.7.2019 (Annexure P-1) whereby she has been transferred from Sub Health Centre, Kumhi, Rajim to Sub Health Centre, Chaildongri, Block Mainpur, under District Gariyabandh.
2.
Counsel for the petitioner submits that the petitioner is a victim of frequent transfer/posting as would be evident from Annexure P-3 to Annexure P-6 wherein it would reveal that the petitioner has been shifted from one place to another on frequent intervals.
3.
Given the said fact that the petitioner has narrated in her writ petition and considering the fact that the petitioner is a Family Rural Health Worker, this Court is of the opinion that ends of justice would meet if the present writ petition itself is disposed of with a direction to the petitioner to prefer a representation to respondent no.4, within a period of 10 days from the date of receipt of copy of this order, highlighting her grievances and the respondent no.4 in turn shall consider the representation and objections raised therein and take appropriate decision at
the earliest, preferably within a period of 30 days from the date of receipt of representation.
4.
Till the representation is decided by respondent no.4, the effect and operation of the impugned order dated 12.7.2019 (Annexure P-1) so far as the petitioner is concerned shall remain stayed.
5.
The writ petition accordingly stands disposed of. Sd/- (P. Sam Koshy) JUDGE /sharad/
