1. Heard on application for restoration of FA No. 165 of 2004 which was dismissed on 28th February, 2019 for want of prosecution.

2. For the reasons mentioned in the application which is duly supported with an affidavit of Ganesh Patel, I am satisfied that sufficient cause has been shown for restoration of FA No. 165 of 2004.

3. Accordingly, MCC is allowed and FA No. 165 of 2004 is restored to its original number and same be fixed for final hearing in the week commencing 9th December, 2019.

4. A copy of this order be placed in the original file of FA No. 165 of 2004.
