Advocate Hon'ble The Vacation Judge Order on Board 22/05/2017 The applicant has preferred this application under Section 439 Cr.P.C. for grant of bail as he has been arrested in connection with Crime No.168 of 2011 registered at Police Station New Rajendra Nagar, District Raipur (Chhattisgarh) for the offence punishable under Sections 409, 420, 467, 468, 471 and 120B of IPC.

It is alleged that co-accused Pawan Agrawal, a Chartered Accountant of Chhattisgarh State Handicraft Development and Distribution Federation, Raipur (henceforth referred as "the Federation") received certain amount towards payment of tax for the Federation but the same was not deposited with the Income Tax Department. He retained the same and embezzled the amount by depositing in the Bank account of several suppliers of the Federation. Pawan Agrawal also submitted forged receipt showing deposit of amount of Income Tax in the assessment year 2008-09 which was not actually deposited at that time but was later on deposited. The allegation against the present applicant is that the amount was disbursed to Pawan Agrawal under his signature together with the signature of the Managing Director.

Considering the fact that the Chartered Accountant Pawan Agrawal has already been released on anticipatory bail in M.Cr.C.(A) No. 100 of 2012 and the present applicant is in jail since 24.03.2017, this Court is inclined to release him on bail.

Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.25,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
