1. In a proceeding of maintenance initiated by the non-applicant, the Family Court finding that there is no dispute of relationship of husband and wife between the parties, further finding that trial of the application for maintenance is likely to take time and that the non-applicant is unable to maintain herself, in the meanwhile, granted interim maintenance of Rs.5,000/- per month which is sought to be challenged by the applicant in this revision stating that the applicant has no income to make payment of the amount of interim compensation.

2. After hearing learned counsel for the parties, considering the facts and circumstances of the case and further the fact that it is only interim compensation that has been granted enabling the non-

applicant wife to maintain herself during the pendency of proceeding, I do not find any illegality in the impugned order. Consequently, the revision is dismissed. However, the Family Court is directed to expedite the trial and conclude the same within a period of three months from the date of receipt of certified copy of this order.
