2. These are the two applications filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the
MCRC No. 8637 of 2020 and another applicants, who have been arrested in connection with Crime No.264/2020 registered at Police Station New Rajendra Nagar, District Raipur (CG) for the offence punishable under Sections 294, 323, 506, 307/34 of the IPC.
3. On a dispute concerning throwing the motorcycle on the ground, the present applicants caused stab wound to the injured on 26.10.2020. The injured was admitted in the hospital for 5 days till 31.10.2020.
4. Although the injury is grievous, but considering that the incident happened on a trivial dispute and there is no previous enmity between the parties as also for the reason that the present applicants are in jail since 2.11.2020 i.e. for more than 4 months and the charge sheet has already been filed, this Court is inclined to release the applicants on regular bail.
5. Accordingly, the applications are allowed and the applicants are directed to be released on bail on each of them furnishing a personal bond for a sum of Rs.50,000/- with one surety each in the like amount to the satisfaction of the trial Court. They are directed to appear before the trial Court on each and every date given by the said Court.
