The present Cr.M.P. has been filed assailing the impugned judgment dated 25.04.2014 passed by the Judicial Magistrate First Class, Raipur in Criminal Complaint Case No.110/2012.

Taking into consideration the evidence of the complainant brought before the Court below particularly in respect of earlier payments which the Respondent has made to the Petitioner, this Court is of the opinion that a strong ground for leave has been made out.

Accordingly the present Cr.M.P. is allowed.

The Registry is directed to register the same as acquittal appeal.

The Acquittal Appeal is also admitted for hearing.

Since, Mr. Raja Sharma has already entered appearance on behalf of the Respondent, the issuance of notice to the Respondent stands dispensed with.

The matter be listed for final hearing in due course.
