The applicant has preferred this bail application as he has been arrested in connection with Crime No.73/2016, registered at Police Station Nagari, District Dhamtari (C.G.) for offence punishable under Sections 44/09, 51 of the Wild Life Protection Act, 1972 and Section 27 of the Indian Forest Act, 1927. 2.

As per prosecution case, the applicant along with 5 other accused persons were traveling in a scorpio jeep on 20.09.2016 and were found to carry two alive tortoises.

Learned State counsel would submit that the applicant has previous antecedents of two offences under the Arms Act and

one offence under Sections 294, 323 & 325 IPC. 4.

Considering the fact that co-accused Gaukaran Prasad Sahu, Ramkumar Sahu, Kuleshwar Kumar Sahu, Motilal Sahu and Gokaran Chaturvedi have already been released on bail by this Court in different bail applications, the present bail application deserves to be and is hereby allowed.

The applicant is directed to be released on bail on his executing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the trial Court. The applicant is directed to appear before the trial Court on each and every date given by the said Court.

In addition to the above, the applicant shall also appear before the concerned Police Station at 11 am on first day of every month during the pendency of the present trial. If the applicant is found involved in committing any other offence during pendency of the present trial, this bail application shall automatically stand dismissed and the concerned Police shall be entitled to re-arrest the applicant after informing the trial Court.
