Hon'ble Shri Justice P. Sam Koshy Order On Board 05.09.2018 The petitioner in the present writ petition had applied for the post of Lecturer (Panchayat) in physics subject. The petitioner was found selected and his name was there in the waiting list no.2. 2.
Counsel for the petitioner submits that the petitioner is placed at serial no.2 in the waiting list and the person at serial no.1 would not be eligible for the said post which fell vacant on account of one of the selected
candidates namely Archna Singh having not joined though an offer was made, it is the petitioner who is eligible for the said post. 3.
Given the said limited dispute which has been raised by the petitioner in this writ petition this Court does not intend to keep the writ petition pending, rather ends of justice would serve if the writ petition is disposed of with a direction to respondent no.3 to consider the claim of the petitioner on due verification so far as his entitlement is concerned that of availability of vacancy on account of non joining of the selected candidates. Let an appropriate decision be taken in this regard within a period of 60 days from the date of receipt of certified copy of this order. Sd/- P. Sam Koshy Judge Bhola
