1. Aggrieved by the impugned order Annexure P-1 dated 24.09.2021 the present writ petition has been filed. By the impugned order, the petitioner has been transferred from Durg to Raipur.

2. The contention of the counsel for petitioner is that the petitioner has got around 5 months of service left for his retirement. He submits that in case the petitioner is transferred at this stage, the pensionary papers may get blocked from being processed timely for releasing of

the post retiral dues. He further submits that the petitioner has also been suffering from prostate cancer and is presently hospitalized and this fact also be considered by the respondent authorities.

3. Given the aforesaid two grounds, the writ petition at this juncture stands disposed of directing the petitioner to make a fresh representation to the respondents 1 & 2 and upon such representation being made, the respondents 1 & 2 shall take a sympathetic consideration on the representation of petitioner and take a decision at the earliest preferably within a period of 60 days from the date of submission of the fresh representation by the petitioner.

4. Meanwhile, purely as an interim measure, there shall be stay of the impugned order till the representation of petitioner is decided. The petitioner, if he has not made a representation, would be entitled to make a representation within a period of 10 days from the date of receipt of copy of this order.
