This is the first bail application under Section 439 Cr.P.C for grant of regular bail as the Applicant is arrested in connection with Crime No.493/2016 registered at Police Station - Kotwali, Korba District Korba (CG) for the offence punishable under Sections 307 and 302/34 IPC. 2.
From the evidence of Parvesh, Raju Yadav and Ansari, it appears that the Applicant had, along with Chotu Bihari, Baba Das and Golu Das, assaulted deceased Salauddin by hands, fists, and kicks and thereafter Golu Das inflicted injuries over the parietal region of deceased Salauddin by means of iron rod.

Learned Counsel for the Applicant submits that the Applicant is innocent and has been falsely implicated in the alleged crime. He submits further that there are no criminal antecedents of similar offence and is therefore liable to
be enlarged on bail.

On the other hand, learned counsel for the State opposed the prayer for bail.

Having considered the facts and circumstances of the case and the nature of allegations, this Court is not inclined to release the Applicant on bail. Accordingly, the bail application filed under Section 439 of the Cr.P.C is hereby rejected.
