This is the First Bail Application under Section 439 of Cr.P.C. The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 819 of 2016, registered at Police Station Kotwali, Raigarh, District Raigarh, for the offence punishable under Sections 379 of I.P.C.

From the applicant's possession two motorcycles were recovered which are suspected to be stolen property. In respect of the another motorcycle, Crime No. 2 of 2017 has been registered in which the present applicant has been released on bail by this Court in M.Cr.C. No. 1420 of 2017 decided on 20.3.2017.

Considering the entire facts and circumstances of the case particularly taking into account the release of the present applicant in another case i.e., Crime No. 2 of 2017, he is entitled to be released on bail.

Accordingly, the bail application is allowed. It is directed that the applicant shall be released on bail on his executing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court.
