The applicants have been arrested in connection with Crime No.209/2021 registered at Police Station - Sariya, District - Raigarh (C.G.) for alleged commission of offences under Section 20-B of the NDPS Act, 1985. 2.

Case of the prosecution is that from the possession of the applicants, 3 kgs of ganja was recovered.

Learned counsel for the applicants submits that the applicants have not committed any offence, they have been falsely implicated and the quantity recovered is more than small quantity but less than commercial quantity. He further submits that the applicants are in jail since 22/09/2021 and charge sheet has been filed.

Learned State counsel opposes bail application. 5.

I have heard learned counsel appearing for the parties and perused the case diary.

Taking into consideration the nature and gravity of allegations, facts and circumstances of the case, pre-trial detention of the applicants and also that the ganja recovered is more than small quantity but less than commercial quantity, this Court is of the view that present is a fit case for grant of bail. 7.

Accordingly, the bail application is allowed. It is directed that the applicants shall be released on bail on each of them furnishing a personal bond in the sum of Rs.1 lakh with one surety in the like sum to the satisfaction of the concerned Trial Court for their appearance as and when directed.
