1. Heard.
2. This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.849/2020 registered at Police Station Out Post-CSEB, Thana Kotwali, District Korba (CG) for the offence punishable under Sections 3, 4, 5 of the Immoral TrafÏc (Prevention) Act.
3. The applicant, an 80 year old Octogenarian, was using his house as a brothel by bringing girls from different towns for
MCRC No. 8565 of 2020 prostitution. On the date of the incident, several persons were found in his house in objectionable position.
4. Although there is one more case of similar nature pending against the applicant but considering that he is in jail since 9.10.2020 and the offence is triable by the Judicial Magistrate First Class, I am inclined to release the applicant on regular bail.
5. Accordingly, the application is allowed and the applicant is directed to be released on bail with the following conditions : (i) he shall furnish a personal bond for a sum of Rs.5 lakhs with two local sureties in the like amount to the satisfaction of the trial Court;
(ii) he shall appear before the trial Court on each and every date given by the said Court;
(iii) he shall not get him himself in the activity, for which, the present crime has been registered;
(iv) if he is found indulging in such activity again, the present bail order shall stand automatically cancelled and the concerned SHO would be entitled to arrest him for the present crime after informing the concerned trial Magistrate.
