(2) The petitioner has efficacious remedy to move an application under Section 439(2) of CrPC before the Court of Sessions.

(3) At this stage, learned counsel appearing for the petitioner submits that he may be permitted to file an application under Section 439(2) of CrPC before the Court of Sessions.

(4) The certified copy of the order impugned be returned to the learned counsel for the petitioner, after furnishing an attested photocopy thereof.

(5) With the above observation, this petition stands finally disposed of.
