The challenge in the present writ petition is to the order Annexure P/1 dated 29.04.2019, passed by the Joint Secretary, Cooperative Societies, Raipur division.

Prima facie this Court is of the opinion that since the order is appealable under Section 77 of the Cooperative Societies Act and there being a statutory alternative remedy available to the petitioner the writ petition would not be maintainable. Reserving the right of the petitioner to avail the said remedy under Section 77, the present writ petition in its present form stands disposed of.

Subject to the petitioner's approaching the Appellate Authority within a period of 15 days from the date of receipt of the copy of this order, the Appellate Authority shall decide the appeal on its merits ignoring the aspect of limitation if any at the earliest preferably within a further period of 45 days in accordance with the Rules and Regulations governing the field. 4.
With the aforesaid observations, the present writ petition stands disposed off.
