The applicant has preferred this application filed under Section 439 of the Cr.P.C. for grant of regular bail as he is arrested in connection with crime No.115/2016 registered in Police Station Kusmunda, Dist. Korba, for offence punishable under Section 302/34 of the Indian Penal Code. 3.

The applicant is a juvenile, aged less than 18 years. He is detained and sent to the Observation Home for causing death

of Narayan Prasad (since deceased) on 2-8-2016. The parents of the applicant namely; Sahasram & Budhwara Bai are also accused in the said case. They have been released on bail by this Court vide order dated 1-2-2017 passed in M.Cr.C.No.424 of 2017. The social investigation report concerning the applicant has not disclosed that he is a habitual offender or that his release on bail would endanger him or it will be prejudicial to the society or family members. 4.

Learned counsel appearing for the State would oppose the bail application.

Considering the facts and circumstances of the case and particularly considering the fact that the parents of the applicant have already been released on bail, this Court is inclined to release the applicant on bail. Accordingly, the application is allowed and the applicant is directed to be released on bail on executing a personal bond by his natural guardian for a sum of Rs.25,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
