On due consideration, I am satisfied that the appellant has succeeded in explaining the cause of delay of 190 days in filing the instant Cr.M.P. and, therefore, the application is allowed. Delay in filing the instant Cr.M.P. is hereby condoned. Also heard on application for grant of leave to appeal under Section 378(3) of the Code of Criminal Procedure, 1973.

On due consideration, leave to appeal as prayed for under Section 378 (3) of the Cr.P.C., is granted.

Let the Cr.M.P. be registered as regular acquittal appeal. The acquittal appeal, being arguable, is admitted for hearing. Issue notice to respondent on payment of process fee as per rules making it returnable within six weeks.
