1. The applicants have preferred this application for grant of bail as they are arrested in connection with Crime No.37/2021 registered in Police Station Excise Circle, Rajnandgaon-B, District Rajnandgaon for offence under Section 34 (2) of the CG Excise Act.

2. Case of the prosecution is that on 16.9.2021 the Police received a secret information that the applicants are in illicit possession of 243 bulk liters of illicit liquor. The applicants were arrested on the same date.

3. Learned counsel for the applicants submit that the applicants are innocent and have been falsely implicated in the crime.

4. Learned State Counsel opposes the bail application.

5. Considering the facts and circumstances of the case, this Court is inclined to release the applicants on bail.

6. Accordingly, the application is allowed and the applicants are directed to be released on bail on the following conditions :- Each of the applicant shall execute a personal bond for a sum of Rs.50,000/- with 2 sureties for the like amount to the satisfaction of the trial Court.

They shall appear before the trial Court on each and every date given by the said Court.

They shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court.

They shall not act in any manner which will be prejudicial to fair and expeditious trial, they shall not involve themselves in any offence of similar nature in future.

While executing the bail bonds, the applicants and the person who stands as surety shall furnish their Full Size coloured Postcard size photograph mentioning their Aadhar numbers and also a copy of the Aadhar Card before the trial Court, which shall be verified from its original by the trial Court.
