Advocate Hon'ble The Vacation Judge Order on Board 24/05/2017 The applicant has preferred this application under Section 439 Cr.P.C. for grant of bail as he has been arrested in connection with Crime No. 70 of 2017 registered at Police Station Kotwali, Korba (Chhattisgarh) for the offence punishable under Sections 381/34 & 414 of IPC. 2.

The applicant was working as cashier in Anupchand Trilokchand Jewelers, Franchise Chhattisgarh Sales Corporation Power House Road Korba. In course of employment with the said jewelry firm, the applicant misappropriated/defalcated ornaments amounting to Rs.40,00,000/-. The said ornaments were handed over to other accused persons who in turn deposited the same with Muthut Finance Company to obtain loan with the help of the employees of the Muthut Finance Company.

Considering the facts that the offence is triable by Judicial Magistrate First Class, the applicant is in jail since 12.02.2017; the charge sheet has already been filed and the concerned SHO has not reported any previous antecedent of the applicant's involvement in similar nature of crime; the alleged transaction was in relation to a private concern and there is no allegation of defalcation qua any fund of the State Govt., the present bail application

deserves to be and is hereby allowed.

Accordingly, the present applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.25,000/- with one surety for the like amount to the satisfaction of the concerned trial Court.
