Hon'ble Shri Justice Goutam Bhaduri Order On Board 14.12.2020 Heard

1. Learned counsel for the petitioner would submit that the petitioner is running an English Medium School wherein under the Right to Education, the students below the poverty line were admitted and according to the scheme, the fees of the students are to be paid in the ratio by the Central Government and the State Government. He would submit that Annexure P-1 would show that the petitioner has not been paid the due amount from 2017-18 till 2019-20 and during this lock-down period, it has resulted in the huge financial bottle necking, therefore, the petitioner has made a representation Annexure P-2 to the District Education Officer, which may

-2be directed to be decided so that the petitioner's amount which is already due are released.

2. Considering the limited prayer made and after perusal of Annexure P-2 dated 20.07.2020, the District Education Officer Rajnandgaon is directed to decide the representation of the petitioner according to the existing policy within a period of 60 days from the date of receipt of a copy of this order. It is further observed, if it is found that the amount is payable to the petitioner that may also be released so that the multiplicity of the litigation can be avoided.
