The applicant has preferred this first bail application under Section 439 of the Cr.P.C. for grant of bail as he has been arrested in connection with Crime No.790/2017, registered at Police Station Bemetara, District Bemetara (CG), for the offence under Sections 419, 420, 467, 468 & 471 read with Section 34 of the Indian Penal Code.

Applicant obtained loan of Rs.2.00 lacs from UCO Bank, Bemetara by fabricating the property papers of Malik Ram and showing the same to be owned by the present applicant.

Learned counsel for the applicant would submit that the loan amount has already been repaid. He would further submit that several co-accused persons have been released on bail by common order dated 8-5-2018 passed in MCrC No.3040 of 2018 & other connected matters.

Learned counsel for the State, per contra, would oppose the bail application.

Considering all the relevant aspects of the matter and particularly considering the fact that the similarly placed co-accused persons have already been released on bail; further considering the fact that the applicant is in jail since 2-11-2020; and the offences are triable by the JMFC, I am of the opinion that present is a fit case to release the applicant on regular bail.

Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court. 8.
