This is the First Bail Application under Section 439 of Cr.P.C. The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 116 of 2017, registered at Police Station Lalbag, District Rajnandgaon, for the offence punishable under Section 34(2) of the Chhattisgarh Excise Act, for illegally possessing 5.400 bulk liters of country made plain liquor.

Having heard counsel for the parties, having regard to the facts and circumstances of the case and considering the fact that the applicant is in jail since 30.3.2017, this Court is inclined to release him on bail. 3.

Accordingly, the bail application is allowed. It is directed that the applicant shall be released on bail on his executing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court. The applicant shall thereafter appear before the trial Court on each and every date given by the said Court. It is made clear that if the applicant involves himself in the offence of similar nature in future, this order granting bail to the applicant shall automatically stand cancelled without further reference to the Bench.
