The petitioner has been aggrieved by continuance of interim order passed against the petitioner in an appeal pending before the Commissioner, Bilaspur Division.

A perusal of order dated 05-08-2016 (Annexure P/2) shows that interim order was passed by the Commissioner on 03-05-2016 and notices were issued and thereafter, the petitioner entered appearance. On 05-08-2016, in presence of the parties, it was recorded that the records of the lower Court was not received and

therefore, records were again summoned. In these circumstances, interim order granted on 03-05-2016 was continued and the case was directed to be listed on 05-10-2016.

Considering the aforesaid circumstances and that the case is coming up for hearing tomorrow i.e. on 05-10-2016, I am not inclined to interfere with the order. However, it is observed that prayer for grant of interim relief shall be considered after hearing both the parties.
