This is the First Bail Application under Section 439 of Cr.P.C. The applicant has preferred this application for grant of bail as she is arrested in connection with Crime No. 101 of 2017, registered at Police Station Berla, District Bemetara, for the offence punishable under Section 34(2) of the Chhattisgarh Excise Act, for illegally possessing 202.860 bulk liters of illicit liquor.

Having heard counsel for the parties, having regard to the facts and circumstances of the case and considering the fact that the applicant is in jail since 3.4.2017, this Court is inclined to release her on bail. 3.
Accordingly, the bail application is allowed. It is directed that the applicant shall be released on bail on her executing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court. The applicant shall thereafter appear before the trial Court on each and every date given by the said Court. It is made clear that if the applicant involves herself in the offence of similar nature in future, this order granting bail to the applicant shall automatically stand cancelled without further reference to the Bench.
