The applicant has preferred this application for grant of anticipatory bail, as he apprehends his arrest in connection with Crime No.123/2019, registered at Police Station Palari, Baloda Bazar-Bhatapara (CG), for offence punishable under Sections 363, 366 & 376 of the Indian Penal Code and Sections 4 and 18 of the POCSO Act.

Albeit the prosecutrix present in the Court states through her lawyer that she has married the applicant, but considering the fact that on the date of incident she was less than 18 years of age and the present is an application for grant of anticipatory bail, this

Court is not inclined to extend the benefit of Section 438 of the Cr.P.C. to the applicant.

Accordingly, the anticipatory bail application is rejected. However, in the event applicant surrenders and moves the regular bail application, the jurisdictional Court shall consider and decide it on the same day.
