This is the First Bail Application under Section 439 of Cr.P.C. The applicants have preferred this application for grant of bail as they are arrested in connection with Crime No. 65 of 2017, registered at Police Station Seepat, District Bilaspur, for the offence punishable under Section 34(2) of the Chhattisgarh Excise Act, for illegally possessing 18 bulk liters of foreign liquor.

Having heard counsel for the parties, having regard to the facts and circumstances of the case and considering the fact that the applicants are in jail since 31.3.2017, this Court is inclined to release them on bail. 3.

Accordingly, the bail application is allowed. It is directed that the applicants shall be released on bail on their executing a personal bond in sum of Rs.25,000/- each with one surety in the like sum to the satisfaction of the concerned trial Court. The applicants shall thereafter appear before the trial Court on each and every date given by the said Court. It is made clear that if the applicants involve themselves in the offence of similar nature in future, this order granting bail to the applicants shall automatically stand cancelled without further reference to the Bench.
