2. The applicant has preferred this application for grant of bail as he is arrested on 10-12-2016 in connection with Crime No. 458/2014 registered in PS Civil Lines, Raipur for offence punishable under Section 419, 420 read with Section 34 of the Indian Penal Code.

Learned counsel for the applicant submits that in the present matter charge sheet has been filed against the applicant and co-accused Omveer Jakhar which is pending for trial before the Chief Judicial Magistrate, Raipur as Cri. Case No. 2140/2017. Co-accused Omveer Jakhad had preferred MCRC No. 1506/2017 and on 17-4-2017, said MCRC was disposed of as withdrawn on the prayer of learned counsel for the applicant. The applicant is an innocent person. He is in jail since 10-12-2016. It is submitted that when the applicant could not clear preliminary examination, there is no question to arrange any other person for appearance in his place. The matter is triable by Judicial Magistrate First Class. He is in custody since long. He may be granted bail.

4. Per contra, learned counsel for the State opposed the argument of learned counsel for the applicant.

5. Perused the entire material.

6. There are prima facie evidence collected during investigation that the applicant arranged other person to give examination in his place. On due consideration, I am not inclined to grant bail to the applicant. Instant MCRC is dismissed.
