Advocate Hon'ble The Vacation Judge Order on Board 24/05/2017 The applicant has preferred this application under Section 439 Cr.P.C. for grant of regular bail as he has been arrested in connection with Crime No. 37 of 2016 registered at Police Station Kansabel, District Jashpur (Chhattisgarh) for the offence punishable under Sections 420, 120(B), 109, 114 & 34 of IPC.

It is alleged that co-accused Lodhan Ram Jadi entered into agreement with several persons and collected an amount of Rs.4,80,000/- to supply Emu birds, which is the species of Australian birds. However, Emu birds were not supplied and therefore, complaint was made by one Ekta Minz. It is alleged that the applicant accompanied Lodhan Ram when he contacted and entered into agreement with several persons. Admittedly, Lodhan Ram Jadi has already been granted regular bail in M.Cr.C. No. 7157/2016. 3.

Considering the release of Lodhan Ram Jadi against whom the allegations are more serious in nature, this Court is inclined to release the present applicant on bail.

Accordingly, this bail application is allowed and the present applicant is

directed to be released on bail on his executing a personal bond for a sum of Rs.25,000/- with one surety for the like amount to the satisfaction of the concerned trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
