Shri Aditya Sharma, Panel Lawyer Hon'ble The Vacation Judge Order on Board 23/05/2017 The applicant has preferred this application under Section 439 Cr.P.C. for grant of bail as he has been arrested in connection with Crime No. 97 of 2015 registered at Police Station Kotwali, Ambikapur, District Surguja (Chhattisgarh) for the offence punishable under Sections 363 & 366 of IPC. 2.
The applicant and the prosecutrix eloped and performed court marriage at Ajamgarh on 01.02.2016 and thereafter, they got married at Sitla temple, Mou on 2nd March, 2016. Her date of birth mentioned in the 10th Class certificate is 12.09.1997 and therefore, on the date of marriage, she was more than 18 years of age.

The applicant was earlier released on bail by the trial Court. However, he has been arrested when his bail bond was cancelled for his failure to appear before the trial Court. At present, he is in jail since 25.04.2017. 4.
Considering the entire facts and situation of the case, this Court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed. The present applicant is directed to be released on bail on his executing a personal bond for a sum of
Rs.25,000/- with one surety for the like amount to the satisfaction of the concerned trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
