1. The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.154/2021 registered in Police Station Sariya, District Raigarh for offence under Section 376 and 506 of the IPC.

2. Case of the prosecution in brief is that the prosecutrix has made a complaint to the police stating that on 22.7.2021 at about 2 pm the applicant called the prosecutrix to meet near the village whereupon the prosecutrix reached where the applicant committed forcible sexual intercourse with her on promise to marry.

3. Learned counsel for the applicant submits that the applicant is an innocent person and has been falsely implicated in the case. The prosecutrix is a major lady and there was love affair between them. The applicant has been arrested on 24.7.2021. Therefore, the applicant may be released on bail.

4. On the other hand, learned State Counsel opposes the bail application.

5. Considering the facts and circumstances of the case, particularly the fact that the prosecutrix is a student and her date of birth being 10th May, 2003, immediately after the incident she informed about the same to her mother and thereafter on the next day the FIR has been lodged, as also the seriousness of the offence and the nature of evidence, this Court does not find fit to enlarge the applicant on bail. Accordingly, the Application is rejected.
