Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 06/10/2016 The transfer order is under challenge mainly on the ground that the petitioner has been transferred from Sarangarh to Jashpurnagar without keeping in view the policy of the Government to keep husband and wife together at same station or at nearby station, as far as possible, subject to administrative exigency. 2.

Learned counsel for the petitioner submits that the wife of the petitioner is also posted and working in the same institution and earlier, she was transferred to the present place in the year 2014.

Considering that the petitioner has remained posted at the present place since long, he is required to be transferred on administrative exigencies. However, considering that the petitioner is a class IV employee and that while transferring the petitioner, respondents have not considered posting of his wife at or nearby station of posting of the petitioner, the matter requires consideration. It is stated that representation has already been made.

Let the representation of the petitioner be decided on or before 31/10/2016. 5.
