Heard on prayer for grant of leave to appeal. 2.

Taking into consideration the submission of learned State counsel that the prosecution led the evidence of homicidal death and presence of respondent with the accused in the house and failure of the accused to explain as to how his mother-in-law died homicidal death when his wife was not at home, we are inclined to grant leave to appeal.

Accordingly, the application for grant of leave to appeal is allowed. The instant Criminal Miscellaneous Petition filed by the learned State counsel be registered as Acquittal Appeal and it be listed for further orders. 4.

In view of above, the instant Criminal Miscellaneous Petition stands disposed off.
