Ms. M. Asha, Panel Lawyer Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 30/08/2018 This is third bail application. The main ground for repetition of the bail application is that the co-accused - Neha Devi as also Mukesh Kumar Yadav have been granted bail by this Court.

Mukesh Kumar was granted bail on a different consideration that he is being involved on the basis of memorandum statement of the co-accused. As far as bail granted to the co-accused Neha Devi is concerned, it is found from the said order that the order passed by this Court on 02/02/2018 in MCrC No.286/2018 (Rajkishore @ Kumar v. Sate of Chhattisgarh) was not brought to the notice of the Court. 3.
Considering that the bail application of the present applicant was rejected on 02/02/2018, taking into consideration the quantity of contraband and that till date, no seizure witness has been examined, at this stage, I am not inclined to grant bail to the applicant. The application is accordingly rejected. It is needless to mention that the Trial Court shall, however, proceed expeditiously.
