Heard on application under Order 41 Rule 19 read with Order 9 Rule 9 of C.P.C. for restoration of Cross Objection filed in MA (C) No. 694 of 2015.

At the time of incident, age of victim was 7 years. He sustained disability of 45% due to accident. The tribunal has awarded Rs. 1 lac. on count of disability. The trial court has awarded in other counts also and in all Rs. 10,25,000/- is awarded. 3.

Since, the tribunal has already awarded on account of disability, the scope for future prospect is merged with disability, therefore, award passed by the trial court needs no modification. 4.
