1. Learned counsel for the petitioner submits that till date, reply has not been filed and the petitioner has come to know from reliable source that the respondents are proceeding to hold DPC for promotion to the next higher post of Assistant Director. He submits that the penalty of withholding one increment with cumulative effect on 11.06.2014 has wrongly been made a basis to deny promotion since 2012.

2. Learned State counsel would submit that the petitioner's case was duly considered earlier and because of the penalty imposed on him in the year 2014, he was not found fit for promotion. He

submits that whenever DPC will be held, his case would again fall for consideration before DPC and his case would be appropriately considered in accordance with law.

3. Learned counsel for the petitioner submitted that in view of the statement made by learned State counsel, this petition may be disposed off at this stage placing on record the aforesaid statement.

4. Accordingly, this petition is disposed off at this stage placing on record the submission made by learned counsel for the State that as and when DPC is held, petitioner's case would be again considered for promotion in accordance with law. Sd/- (Manindra Mohan Shrivastava) J U D G E Rekha
