Mr. K. K. Pandey, Advocate For Respondent :

Mr. R. K. Gupta, Advocate Hon'ble Shri Justice P. Sam Koshy Order on Board 19/03/2019

1. Present contempt petition has been filed alleging wilful non compliance of the order dated 18/06/2018 passed in WPS No. 3993/2018. The operative part of the order passed by this Court is as under:- "Be that it may, the writ petition itself is therefore being disposed off with a direction to the petitioner to make a representation to the respondent No. 2 in this regard, who in turn shall personally scrutinize the representation of the petitioner and shall objectively decide the same."

2. On notice, counsel for the respondent has produced before this Court the order dated 22/09/2018 and a copy of which also made available to the counsel for the applicant. The plain reading of the order dated 22/09/2018 would show that the respondents have considered the

representation which the petitioner had filed and have deciding the same rejected the claim put forth by the petitioner. Rightly or wrongly directions given by this Court appears to have been complied with. Applicant if he is not satisfied with the findings given by the authorities concerned, the order dated 22/09/2018 being a fresh cause of action would have to be challenged by the applicant in an appropriate proceedings, which cannot be tested in a contempt jurisdiction by this Court.

3. Reserving the right of the petitioner to challenge the same, contempt petition accordingly stands disposed off.
