NAFR HIGH COURT OF CHHATTISGARH, BILASPUR WPS No. 5632 of 2016 • R. L. Paikra S/o Late Shri Sukhiram Paikra, Aged About 61 Years R/o New Forest Colony, Kumharpara, Jagdalpur, Police Station Bodhghat, District Bastar, (Chhattisgarh) ---- Petitioner

Versus

1. State Of Chhattisgarh Through The Secretary, Forest Department, Mahanadi Bhawan, Mantralaya, New Raipur, (Chhattisgarh)

2. Divisional Forest Officer, Forest Division, Bastar, District Bastar, (Chhattisgarh) ---- Respondents ------------------------------------------------------------------------------------------------------------ For Petitioner :

Mr. Prateek Sharma, Advocate For State / Respondents :

Mr. R.K. Gupta, Dy. Advocate General ------------------------------------------------------------------------------------------------------------ Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 19/10/2016 Heard.

1.

Order dated 27.09.2016 is under challenge on the ground that though the petitioner has remained posted in scheduled area continuously for nine years, he has not been considered for transfer outside the scheduled area. He is locally shifted to the Office of Chief Conservator of Forest, Jagdalpur.

2.

Present is not a case where the petitioner is being transferred to another station, but, is locally shifted within the headquarter. The petitioner is only being shifted from one place to other place at Jagdalpur only. The petitioner will be at liberty to apply for transfer outside the scheduled area before the transferring authority in the next transfer season. 3.

Considering that it is local arrangement, I am not inclined to interfere with transfer order in exercise of extraordinary jurisdiction under Article 226 of the Constitution of India.

4.

The petition is accordingly disposed off.
